1. About the platform
KINS provides online tools for food businesses to publish and manage digital menus, take orders and offer coupons and loyalty programs, along with other operational modules in the future.
2. Account and access
- You are responsible for the accuracy of the information you provide and for keeping your password safe.
- The account holder is responsible for the actions of the people they invite to their organization.
- We may suspend accounts that violate these terms or applicable law.
3. Restaurant content
Prices, descriptions, images and other published information are the responsibility of the restaurant, which declares that it holds the rights to the material it uploads.
The rules for coupons and the loyalty program (discounts, rewards, expiration and limits) are set by the restaurant, which is responsible for them toward its customers.
4. Evolving features
Features identified as “in development” or “planned” are not part of the service until their official launch.
5. Plans and subscriptions
- Free plan: the Free plan has no expiration date and no cost. The features and limits of each plan are on the pricing page.
- Subscription and billing: paid plans are billed on a recurring basis (monthly or yearly, as chosen), by credit card, processed by Stripe. The subscription renews automatically at the end of each period until it is canceled.
- Trial period: when a plan offers a free trial, it applies once per organization; the first charge happens at the end of the trial unless canceled before then.
- Upgrade: moving to a higher plan takes effect immediately, with a prorated charge for the remaining period.
- Downgrade: moving to a lower plan takes effect at the end of the period already paid, with no prorated refund.
- Cancellation: can be done at any time in the dashboard; access to the plan continues until the end of the paid period, after which the account moves to the Free plan.
- Limits and data: when moving to a plan with fewer features, no data is deleted automatically; features not included simply stop working and new additions above the limits are blocked.
- Prices: price changes never affect periods already paid and are announced in advance before the next renewal.
- Failed payments: if a charge fails, Stripe retries it and the plan’s features remain available during that time; without payment, the subscription ends and the account moves to the Free plan.
6. Payments through the menu
- Who processes them: Pix and credit card payments on the menu are processed by Pagar.me. The amount paid by the customer is credited directly to the restaurant’s Pagar.me balance and transferred to the registered bank account, according to Pagar.me’s rules and timelines. KINS does not receive or hold the money from orders.
- Registration: to receive payments, the restaurant registers a payout account and accepts Pagar.me’s terms, including identity verification. The bank account must be under the same CPF or CNPJ (Brazilian tax IDs) as the account holder.
- Fees and installments: Pagar.me’s processing fee is deducted from the amount received by the restaurant. For cards, installments offered to the customer are interest-free and their cost is borne by the restaurant. Any per-transaction fee from KINS is shown in the dashboard before it takes effect and never applies to payments already made.
- Orders and refunds: an order paid through the menu only reaches the restaurant after the payment is confirmed. If the order is declined or canceled after payment, the amount is refunded to the customer; partial refunds can be made from the dashboard. The restaurant is responsible for customer service regarding the order, including exchanges, cancellations and refunds.
- Disputes (chargebacks): disputes over card purchases are handled by Pagar.me according to the card networks’ rules, and the disputed amount may be debited from the restaurant’s balance.
